Resolving Disputes:

Alternative Dispute Resolution can be defined as:

"... any type of procedure or combination of procedures voluntarily used to resolve issues in controversy. ADR procedures may include but are not limited to conciliation, facilitation, mediation, early neutral evaluation, adjudication, arbitration and the use of ombudsmen. "

There is no mystery to commercial ADR; strip it down it is a business tool that has the potential to reduce costs and ultimately add to shareholder value.   ADR can bring about swift and cost effective closure of business disputes prior early.  Commercial ADR is not a panacea; it is an alternative form of facilitated commercial negotiation.  Commercial Mediation, deployed well, can be a very effective tool in solving seemingly intractable disputes; deployed poorly, it is merely another layer of cost.  Crannagh & Co are experts in Commercial Mediation.

Dispute is part of business:

Dispute is a fundamental part of doing business.  Intelligent business leaders recognise and address the threat posed by disputes with customers, clients or business / trading partners such as suppliers or clients.  In a downturn environment characterised by lengthening debtor days and hardening credit facilities the prudent management of extant or emerging commercial disputes should be point of particular management focus.  Strong business leadership builds systems and internal capability within its organisation to manage the inherent business risk presented by the increasing emergence of commercial disputes.

Crannagh & Co are experts in domestic and international commercial dispute resolution

Crannagh & Co’s approach is guided by their belief that commercial disputes are part and parcel of the normal business cycle.  As such, dispute management and resolution should be included in a business’ performance measurement and should be made part of the organisations’ management information systems and reporting structures.

Ireland, one of the most open economies in the world, supports the resolution of business disputes outside traditional litigation.

Alternative dispute resolution has been a facet of Ireland’s common law legal system for many years.  In keeping with the mainstreaming of ADR in other common law jurisdictions around the world alternative dispute resolution including commercial mediation has been the subject of recent Irish legislation, numerous positive and supportive pronouncements by the Irish judiciary and exhaustive study by the Law Reform Commission.  Please see the attached link to the Irish Law Reform Commission’s Consultation Paper on ADR for an overview of Alternative Dispute Resolution in Ireland LINK TO LRC Paper on ADR.

Our dispute resolution methodology is practical and business focused; we hone in on the real issues and obstacles behind any commercial dispute as a starting point in our search for a strong and commercially viable solution.
